Terms of Service

These Terms of Service ("Terms") govern your use of the HaterPicks platform, including the website, the iOS and Android apps, the dashboard, and any related services (collectively, the "Service"), operated by HaterPicks Pty Ltd ("HaterPicks", "we", "us", or "our"). These are the Terms for members whose account is in the United States.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

HaterPicks is an information and research service. We are not a sportsbook: we do not accept wagers, hold funds, or settle bets, and nothing on the Service is betting advice.

1. Eligibility

You must be at least 21 years old to use HaterPicks. By using the Service, you represent that you are of legal age to form a binding contract in your state, and that you will only place wagers with operators licensed where you are located. Sports wagering is not legal in every state. We make no representation that any sportsbook shown on the Service is available to you where you are.

2. Account Registration

To access the Service, you must create an account with a valid email address and password, or sign in via a supported third-party provider (Google or Apple). You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and account
• Accept responsibility for all activity that occurs under your account
• Verify your email address before gaining full access to the Service

Your account's country is set when you sign up and decides which version of the Service, prices, and these Terms apply to you. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Subscriptions and Free Trial

3.1 Free Trial

New subscribers may be offered a free trial period of 3 days. A valid payment method is required to start the free trial. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription and your payment method will be charged at the applicable rate.

3.2 Subscription Plans

We offer the following subscription plans:

• Weekly: $12.95 per week (US dollars), billed weekly
• Monthly: $39.95 per month (US dollars), billed monthly

Prices are in US dollars (USD). Sales tax is added where your state requires it and is shown before you pay. We reserve the right to change pricing with 14 days' notice. Existing subscribers will be notified by email before any price change takes effect.

3.3 Billing and Renewal

Subscriptions renew automatically at the end of each billing period. Your payment method will be charged on the renewal date unless you cancel before the end of the current billing period. Payments on the web are processed securely through Stripe; we do not store your full card details on our servers.

If you subscribe in the iOS or Android app, Apple or Google bills you at the price shown in the store, and their terms govern that purchase, its renewal, and refunds for it. Manage or cancel an app subscription in your App Store or Google Play account settings, at least 24 hours before the current period ends.

3.4 Automatic Renewal Disclosure

Your subscription continues and renews automatically, and you authorize us to charge your payment method each period at the then-current rate, until you cancel. You can cancel online at any time from your account profile, with no need to call or write to us, or by emailing support@haterpicks.app.

3.5 Cancellation

Cancellation takes effect at the end of the current billing period — you will retain access to the Service until then. No partial refunds are issued for unused time within a billing period, except as described in our Refund Policy.

4. Refunds

If the Service isn't what you expected, contact support within 30 days of your first payment for a refund. Refunds are not conditional on betting outcomes: the Service provides information and tools, and makes no representation that you will profit from using it.

5. Acceptable Use

You agree not to:

• Share your account credentials or allow others to access your account
• Redistribute, resell, or commercially exploit any content from the Service
• Use automated tools, bots, or scrapers to access the Service
• Circumvent any access controls, subscription checks, or security measures
• Create multiple accounts to abuse free trials or promotional offers
• Use the Service for any unlawful purpose, including wagering where it is not legal

6. Intellectual Property

All content on the Service — including picks, projections, analysis, statistics, software, and design — is owned by HaterPicks or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, to the fullest extent permitted by law. HaterPicks provides sports analysis and projections for informational and entertainment purposes only. We do not guarantee the accuracy, completeness, or reliability of any picks, projections, odds, or other content.

HaterPicks does not guarantee that you will profit from using the Service. Sports betting involves inherent risk, and past performance does not guarantee future results. You are solely responsible for your betting decisions and any resulting financial outcomes.

8. Limitation of Liability

To the maximum extent permitted by law, HaterPicks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, arising from:

• Your use of, or inability to use, the Service
• Any betting losses incurred based on information provided by the Service
• Unauthorized access to your account
• Any interruption or cessation of the Service

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the total amount you have paid us in the 3 months preceding the claim. Some states do not allow the exclusion or limitation of certain damages, so some of these limits may not apply to you.

9. Responsible Gambling

We reserve the right to restrict or close accounts if we have reason to believe the Service is being used in a way that is harmful to the user.

10. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time. We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

HaterPicks Pty Ltd is an Australian company. These Terms are governed by the laws of the State of Victoria, Australia, without regard to its conflict-of-laws rules. Nothing in these Terms limits any right you have under the consumer protection laws of your state of residence that cannot be waived by contract, and you may bring a claim in the courts of your state of residence where those laws allow it.
